SAWIA BLOG, established under the Centre for Multi-Justice Systems at Kabarak University, is a new scholarly forum that seeks to explore, analyses, and contribute to the growing body of knowledge on Alternative Dispute Resolution (ADR) by providing a platform for exchanging knowledge and ideas and reflecting on the evolution of an alternative form of justice.
ADR has become an effective and accessible mechanism for resolving conflicts outside litigation processes. ADR offers parties flexible, efficient, and amicable solutions through less adversarial methods of resolving disputes, like mediation, negotiation, and arbitration, which is critical in a world where efficiency and the preservation of relationships are important.
However, within ADR, arbitration stands out as a key mechanism, offering a binding, private process tailored to the disputing parties' specific needs. In recent years, arbitration has become the preferred method of dispute resolution in sectors such as international trade, construction, intellectual property, and investor-state conflicts.
